Looks like the much-talked about hot topic from several months ago, The Orphan Works Act of 2008 (previously), died a “quiet death” in the House, after it passed in the Senate.

Folks-
The bill isn’t dead yet. They’re attempting “A fly under the radar” expedition by hotlining the issue.
In order for a bill to be hotlined, the Senate Majority Leader and Minority Leader must agree to pass it by unanimous consent, without a roll-call vote. The two leaders then inform Members of this agreement using special hotlines installed in each office and give Members a specified amount of time to object – in some cases as little as 15 minutes. If no objection is registered, the bill is passed.
Call your reps today before the House passes it on Thursday, Oct 2nd.

We need you to contact your Senator immediately to oppose S. 2913. Word from Senator Leahy's office today that Senators Leahy and Hatch are pushing the Senate to hotline S.2913, "The Shawn Bentley Orphan Works Act of 2008" today or this weekend! There is a possibility that Leahy's Orphan Works bill may be tacked onto another economic bill related to current events and quickly passed first by the Senate and then by the House.
Senator Leahy has just released an amendment to his bill, but the amendment still does not include the Notice of Use (NOU) nor an archive of NOU filings. Without the Notice of Use provision, the Graphic Artists Guild continues to oppose the Senate Orphan Works bill, S. 2913
when you find a lizard in your house. Last week I found a tiny lizard skittering up the wall next to the fireplace. Fortunately we were able to catch him in a paper cup before the cat had any idea of what was going on. I tried to take a picture of him, but it was dark outside and he was rather camera shy. I think he might have been a Mediterranean Gecko. It must be lizard-hatching season or something because another baby lizard had taken up residence in my fern for a while. He was a little less camera-shy:
Well, I’m just beginning work on a new book project, so I probably won’t be posting much by way of art for quite some time. I’ll give out more details about the book when I’m closer to finishing and when the title is finalized and such. In the meantime, here are a couple of illustrations I painted for Spider last year. The (true!) story was about some beavers that found a bag of stolen money and used it to construct their lodge. I was particularly pleased with the way the water turned out on the second piece:

Wow, I never thought I’d say this but… the system… works?
We’ll be able to say that “the system works” when some sane legislation which effectively deals with the problem of orphan works in a way that doesn’t impose an unnecessary burden on creators gets passed.
I’m not holding my breath on that one. In the mean time, good riddance.

Oh, come on guys… seriously. That article is completely misleading. The Orphan Works Bill isn’t dead at all. It won’t be dead until it’s voted down completely.
Notice who told Threat Alert that it’s a dead deal. Not a congressman, not a congressional aide. But a lobbist. Lobbists? Are you kidding me? Those guys could assure me that the moon is made of green cheese and tomorrow it will start raining solid gold kittens and I would believe those assurances more than them telling me that they know what is going on with legislation. Notice also that TA didn’t say who the lobbists were working for. Are they working for the artists’ rights groups or the corporations? This is important information, don’t you think?
Write your congressperson. Tell them that the measure needs to be defeated. Don’t quit just because someone who is paid to talk to politicians has said it’s safe. That’s like standing in the eye of a hurricane and saying, “Wow, I’m glad that storm is over. Okay, back to normal!”
